The Ministry of Justice of Ukraine has clarified what property owners should do if their housing documents were lost or destroyed, and their ownership was registered before January 1, 2013. Due to the full-scale war, many Ukrainians have lost paper documents for their apartments and houses, but the loss of a document does not mean the loss of ownership rights.

However, if there is no information about the real estate in the State Register of Proprietary Rights to Real Property (DRRP), it may be more difficult for the owner to sell or inherit the property, as well as to receive compensation for damaged or destroyed housing under the “єВідновлення” program.

According to the Ministry of Justice, one should first try to restore the document, and if this is not possible, confirm the ownership through court.

Action Plan for Homeowners

  • Obtain a duplicate of the ownership document. To do this, you need to contact the institution that issued the original document. This could be a local self-government body if the housing was registered through a council decision, or a notary or state notary archive if the right arose based on a sale, gift, exchange, or inheritance agreement.
  • If the institution is liquidated, documents are destroyed, or remain in the temporarily occupied territory and it is impossible to obtain a duplicate, the owner will have to go to court.

  • Establish ownership through court. You will need to file a lawsuit to recognize the right of ownership of the real estate. Any documents that confirm the person’s connection with the property can be attached to the application: technical passport, archival certificates, land allocation decisions, documents from the Bureau of Technical Inventory (BTI), or witness testimonies.
  • After obtaining a court decision and it comes into legal force, it can be used to register the ownership right.

  • Enter the housing data into the DRRP. To do this, you need to contact a state registrar or notary, providing the court decision, passport, and taxpayer identification number. Registration can be carried out at any location in Ukraine – it does not depend on the location of the real estate.
  • After entering the information into the State Register of Proprietary Rights, the owner will have official confirmation of their property rights and will be able to fully utilize state support programs.
